Terms of Use – Find My Therapy

These Terms of Use (“Terms”) apply to your access to and use of the website, web application and services operated by Find My Therapy Pty Ltd (“Find My Therapy”, “we”, “us”, “our”).

By accessing or using our website or services, you agree to be bound by:

  • these Terms; and

  • our Privacy Policy.

If you do not agree, you must not use our website or services.

1. About our services (information only, not medical advice)

1.1 Find My Therapy is an online directory and information platform that helps people in Australia find and connect with allied health professionals (“Services”).

1.2 Our platform and any related content (including practitioner profiles, articles, guides, fact sheets, FAQs and other materials):

  • are provided for general information and educational purposes only;

  • are not medical, psychological, diagnostic, therapeutic or professional advice;

  • should not be relied on to diagnose, treat, cure or prevent any medical condition; and

  • do not constitute an an endorsement or recommendation of any particular practitioner, treatment, test, service or product.

1.3  You must always seek the advice of a qualified health professional regarding any medical or mental health condition and must not delay or disregard professional advice because of information found on Find My Therapy.

1.4 Your use of our website or services does not create any practitioner–patient, client–therapist, fiduciary or clinical relationship with Find My Therapy.

1.5  If you believe you are experiencing a medical emergency or crisis, call 000 (Australia) or seek immediate assistance.services.

2. Changes to these Terms

2.1 We may update these Terms from time to time by publishing a revised version on our website.

2.2 Continued use of the website or services after changes take effect constitutes acceptance of the updated Terms.

2.3 Where changes are material, we will use reasonable efforts to provide at least 14 days’ notice.

2.4 If you do not agree with the updated Terms, you should stop using the website and request closure of your account.

  • you will promptly update your details if they change;

  • you are not impersonating any person or entity; and

  • you are not violating any applicable law relating to identity or personal information.

3.3 You are responsible for:

  • maintaining the confidentiality of your Credentials;

  • all activity that occurs under your account; and

  • notifying us promptly if you suspect unauthorised access or a security breach.

3.4 We may, at our discretion, suspend or terminate any account if we reasonably believe that our brand, reputation, operations or other users may be harmed by the account or content associated with it, or if these Terms are breached.

4. Additional obligations for practitioners and clinics

4.1 Practitioners and clinics represent and warrant that:

  • all profile information is accurate and not misleading;

  • required registrations, licences and insurance are maintained;

  • advertising complies with applicable laws, including the Australian Consumer Law and AHPRA advertising guidelines; and

  • information is updated promptly if it changes.

4.2 We may verify information and suspend, edit or remove listings that are inaccurate, misleading, unlawful or non-compliant.

4.3 Practitioners remain solely responsible for:

  • their professional conduct;

  • all advice, treatment and services provided; and

  • any clinical or contractual relationship with clients.

Find My Therapy does not employ, supervise or control practitioners.

5. Your responsibilities when using the website

5.1 You must use the website lawfully and in accordance with these Terms.

5.2 You must not:

  • post misleading, unlawful, abusive or inappropriate content;

  • make prohibited health claims or guarantees;

  • post non-compliant testimonials or reviews;

  • engage in spam or unsolicited communications;

  • interfere with website security or functionality.

5.3 We may suspend or terminate accounts involved in misuse or spam activity.

6. Automated tools and scraping

6.1 You must not use automated tools (including bots, scrapers or data-mining tools) without prior written consent.

6.2 Standard search engine indexing is permitted.

7. Content you submit or post

7.1 Users may submit content including practitioner profile information and communications (“User Content”).

7.2 You are solely responsible for your User Content and must ensure it:

  • is accurate and not misleading;

  • complies with health advertising laws;

  • does not infringe third-party rights.

7.3 Testimonials relating to regulated health services may be restricted, moderated or removed to ensure compliance with AHPRA and other regulatory requirements.

7.4 By submitting User Content, you grant Find My Therapy a worldwide, royalty-free, non-exclusive licence to use that content in connection with operating and promoting the platform.

7.5 We may remove or edit User Content at our discretion.

8. Our intellectual property and your limited licence

8.1 Find My Therapy owns all intellectual property in the website, branding, design, and original content.

8.2 You are granted a limited, non-transferable licence to access and use the website for lawful purposes only.

8.3 You must not reproduce, distribute or exploit any part of the website without written consent.

 

9. Fees, subscriptions, billing and cancellation

9.1 Some features require payment of subscription or service fees.

9.2 Fees, billing frequency and terms are disclosed before purchase.

9.3 Subscriptions:

  • are billed in advance;

  • may be cancelled at any time; and

  • remain active until the end of the current billing period.

9.4 Fees are non-refundable unless required by law.

9.5 Nothing in these Terms limits your rights under the Australian Consumer Law.

 

10. Third-party services and links

0.1 We may link to third-party booking, payment or practice management systems.

10.2 We do not control or endorse third-party services and are not responsible for their availability, security, transactions or performance.

10.3 Use of third-party services is subject to their own terms and privacy policies.

11. Limitation of liability

11.1 To the maximum extent permitted by law, Find My Therapy excludes liability for any loss arising from:

  • use of the website or services;

  • reliance on content;

  • practitioner conduct or services; or

  • third-party platforms.

11.2 Where liability cannot be excluded, it is limited to re-supplying the services or paying the cost of re-supply.

11.3 We are not liable for indirect or consequential loss.

12. Indemnity

You agree to indemnify Find My Therapy against claims arising from your breach of these Terms, your User Content, or (for practitioners) your professional services or advertising conduct.

13. Suspension and termination

We may suspend or terminate access for breaches of these Terms. You may close your account at any time.

14. Accessibility

We aim to make our website accessible to a broad range of users, including people with disability. Accessibility feedback is welcome.

15. Governing law

These Terms are governed by the laws of Australia, and the courts of the relevant State or Territory have exclusive jurisdiction.
